Think of bankruptcy as a "protection plan."  It is an excellent way to protect your future and your family by giving you debt relief and an effective way to fight foreclosures, wage garnishment, repossessions  and other collection action.  Most consumers choose between Chapter 7 and Chapter 13 bankruptcies for the needed protection.

In Chapter 7 bankruptcy, you are required to sell off a portion of your assets to pay off your debts.  Although there are income requirements that determine your eligibility for Chapter 7 protection, many debtors fall within the guidelines and do not have enough assets to be worried about selling them.

Chapter 13 bankruptcy gives you an opportunity to develop a court approved payment plan that fits your budget.  Debtors usually file Chapter 13 when they do not qualify for a Chapter 7 and are attempting to keep major assets such as a home.  Depending on several factors the plan can last for three to five years.  After successful completion of the plan, you may have the remainder of your dischargeable debts wiped out.
